The crux of this matter is that the Nissan is recalling almost a million cars and trucks, 2013-14 model years, because the front passenger-side air bag might not deploy in a crash. The reason for the defect purportedly is that a software problem in the occupant classification system might not detect an occupant in that seat. The automaker blamed the “sensitivity” of the software calibration, particularly when “a combination of factors such as high engine vibration at idle [sic] when the seat is initially empty and then becomes occupied” or an “unusual” seating posture are factors.

In short, Nissan has placed a defective product into commerce that must be recalled. At least for now, however, Nissan states the passenger might be partially at fault because he/she sits funky or lets the engine idle too long and before allowing a passenger to get in and before the car is turned off and then on again with the passenger in the seat. It seems Nissan has no conception of school pick-up, etc.

If YOU ARE A PERSON OR KNOW OF A PERSON WHO OWNS/OWNED, OR LEASES/LEASED ONE OF THE VEHICLES LISTED ABOVE, PLEASE CONTACT US AS SOON AS POSSIBLE.

We beleive this defect exists and side passengers should be placed in the back seat for now. Interestingly, Nissan’s letter to NHTSA coming clean states that it will notify dealers starting April 11 and then owners later in the month.

Please submit the following information so we can determine if you qualify for the suit. If you don't know all the specific details, partial information is also acceptable.
